First-party
A first party developer is a subsidiary of Microsoft and one in which Microsoft has a controlling interest in (51% or more ownership).
Current first-party
Rare- Formerly a second-party developer to Nintendo, Microsoft bought Rare in September of 2002. Rare has since made for the Xbox/Xbox 360. Grabbed by the Ghoulies, Conker: Live and Reloaded, Kameo, Perfect Dark Zero, Viva Piñata, and Banjo Kazooie Nuts and Bolts.

Xbox Live Productions- A new first-party studio set up to develop Xbox Live Arcade games and digital video content.

Second-party
A second-party developer is one that creates games exclusively for Xbox systems through a contract agreement. Microsoft may or may not own a percentage of the studio, but not enough to give it a controlling interest.
