Gang Stalking Controversy

Gang stalking is an issue that has a large following on the internet with numerous sites dedicated to this topic. Proponents believe this is a real “tech age” crime. Skeptics believe it to be nothing more than a form of psychosis.
Proponent point of view
Proponents argue Gang Stalking is a form Cyberstalking that adds the element of Mobbing. When cyberstalkers elicit the help of locals to physically stalk a victim or vise versa, usually through a slander campaign, this is commonly referred to as Gang Stalking.
Victims are often selected online and are then pursued in the real world. In some cases resentful acquaintances of targets will elicit the help of cyberstalkers online. In any case gang stalking is defined by “ganging up" on a target using both conventional and cyber-bullying methods. The group will usually recruit accomplices by accusing the victim of doing something objectionable and therefore “deserving it.” They then turn it into a sadistic “game."
False claims of stalking and delusions of persecution
People with persecutory delusions tend to confuse the issue of gang stalking. These people falsely believe they are being victimized, and it’s usually obvious. People suffering from schizophrenia and other delusional disorders typically exhibit outlandish believes involving such things as "psychotronic weapons" and other forms of “mind control.” People with paranoid delusions are highly suggestible and confused, whereas actual victims have coherent accounts of their abuse that are verifiable. To the average observer there might not be a clear distinction between legitimate victims of stalking and those who have mental illnesses, but a mental health professional can usually clearly distinguish.
Terminology confusion
There has been much confusion as to the proper terminology for this new age crime. Development of a universally agreed apon and understood definition has been slow and frustrating for victims.
Victims agree however that cyberstalking is not a strong or accurate enough term to describe the combination of online and real world abuse they are subjected to.
Federal Case
A Federal court civil rights law suit was filed on 7/9/2010 in the Southern district of New York against the United States and unnamed citizen group for alleged abuses including stalking, conspiracy and assault. The plaintiff claims he is the victim of a Red Squad like crime known as “Gang Stalking.”

Implications
The Government has chosen a Facial, instead of Factual defense, asking this Court to dismiss this case under Rule 12(b)(1) and (6). The Government acknowledged for a facial defense, under Rule 12(b)(6), the court is “required to accept the material facts alleged in the complaint as true.”
The Government’s primary facial argument is Sovereign immunity.
Plaintiff argued that Sovereign immunity does not apply in this case because the indiscretions alleged are not official duties of the Government.
Plaintiff cited the case of the: Socialist Workers Party v. Attorney General, 463 F.Supp. 515, 522-24 (S.D.N.Y. 1978). In this case the SWP relied on the theory of ‘prima facie tort’ in connection with the FBI’s (Red Squad) disruption activities. This led to the decision denying the Government’s motion to dismiss certain claims. Socialist Workers Party v. Attorney General, 463 F.Supp. 515, 522-24 (S.D.N.Y. 1978).
The Government replied by arguing that the legal interpretation that granted the SWP an award has subsequently been rejected.
Plaintiff concluded his argument by stating: “If it is decided by this court, due to sovereign immunity, that the American people have no legal cause to act against the government for committing conspiracy, then this court is setting precedence that technically it is legally acceptable for any government official to use third party thugs to attack citizens.”
Media attention
The mainstream media are just starting to acknowledge gang stalking as a unique form of abuse.
The Central Coast News of Santa Cruz California and Kens5 of San Antonio Texas are some of the first.
This issue has been previously discussed on talk shows including Conan O'Brian, Howard Stern, Z100 radio and others.
Books
A private investigator who wrote a book about his observations of one of these groups described members as: “Those who feel powerless, inferior and angry. Leaders focus that anger on their targets. Some members appear to have mental problems. They are empowered by the group.”

Ted Gunderson
Theodore L. Gunderson is a retired United States Federal Bureau of Investigation Special Agent. During his time with the FBI he was involved in the COINTELPRO program.
After retiring from the FBI, Gunderson set up a private investigation firm, Ted L. Gunderson and Associates, in Santa Monica.
He provided an affidavit about Gang Stalking regarding Freedom of Information Request No. 10-00169
