Acting President of India

An Acting President is a person who temporarily fills the role of an organization's or country's president, either when the real president is unavailable (for example ill or on vacation) or when the post is vacant (for example because of death, injury, resignation, or dismissal).

The post of President of India in (Hindi: राष्ट्रपति), a Sanskrit neologism meaning "lord of the realm".

There were many acting presidents of India ,who took over the charge in case of removal or death of the current President of India. There have been 13 Presidents of India and 3 Acting Presidents of the country till now. Varahagiri Venkata Giri was the only person to become President of India after his acting tenure as a constitutional head of the country.The other two were Mohammad Hidayatullah and Basappa Danappa Jatti.

Conditions

The Constitution provides that should "there occur a vacancy in the office of the President , the Vice President of India shall act as the President until by the time a new President of India is elected according to the (Article 65(1)). If the vacancy is going to be caused by a regular expiration of the term of the President, elections have to be completed before the term expires. Even if there is a brief interregnum owing to a delay of the elections, the President shall continue to hold office until his successor enters upon the office as per (Article 56(1)c). This circumstances can only occur if the following things occurs:

  • Death of the President
  • Resignation of the President
  • Removal of the President by impeachment
  • Invalidation of the election of the President by the Supreme Court
  • If the President of India is ill or sick ,The Vice President of India can take charge as President till he recovers

First Case Of Taking Charge

  1. The inaugural Vice President of India Dr. Sarvepalli Radhakrishnan was himself the first Vice President of the country to discharge the functions of the President, when the then President of India Dr. Rajendra Prasad was away from the country for fifteen days on a tour to the Soviet Union in the year 1960.
  2. The First acting president of the country was Varahagiri Venkata Giri as the then President of the country Dr. Zakir Hussain died while in office
