Xavier et Fils Legal Fiasco Ends in Tragedy

In March 2011 a number of complaints started appearing on the portal http://www.callercenter.com against a car warranty company operating out of Montreal, QC.

People complaiend that Montreal Based telemarketing firm, "Assurance Auto Xavier et Fils", was making robo-calls instructing people to press 1 to sign up for insurance. Recorded message also advised people that if they didn't press 1 they faced legal actions and their car may be seized.

In Quebec it is illegal to drive without car insurance, hence many pressed 1 to sign up for the Warranty. As per callercenter complaints the company used deceptive tactics in order to get people to switch their car insurance.

The representative from "Xavier et Fils" contacted the owner of CallerCenter.com on several occasions requesting removal of the complaint page . When his requests were denied he sent a Cease and desist letter saying that legal actions will be taken against the complaint board if they didn't immedietly remove the page.

Surprisingly the owner of the callercenter.com portal resides in the same city as "Assurance Xavier et Fils", so he accepted to litigate in the "Cour des petites créances" in Palais de Justice de Montreal. The courts appearance was later cancelled by the claimant. As per the owner of Callercenter he could not find any company records and believes that no such company ever existed. He thinks it may have been a one man operation where the person worked as a telemarketer with a leased toll free number.

Complaints currently remain on the portal with no new updates as of May 2011.
