State of Louisiana v. Frisard, 694 So. 2d 1032 (La.App. 5 Cir. 4/29/97) was a civil trial. The Court ruled that the defendant, Emile C. Frisard, III, was liable for child support to the plaintiff, Debra A. Rojas, because Rojas had successfully met the legal burden of proof necessary to establish paternity. Testimony Frisard testified that Rojas performed oral sex on him while he wore a condom, and that sexual intercourse did not occur. His testimony stated that he believed Rojas inseminated herself using a "red looking bulb with a glass tube" with semen retained from the condom. Rojas testified that they had engaged in sexual intercourse. DNA testing resulted in a 99.9994% probability of paternity. Court decision The Jefferson Parish Court found that Rojas met the legal burden of proof to establish paternity, and that Frisard was thus liable for child support. References See Also
