Gale P. Elston

Gale P. Elston is an Art Law, Intellectual Property and Real Property Attorney, licensed to practice in New York and California.
Elston was born in Hartford, Connecticut and raised in Spokane, Washington. She graduated with a B.A. from Creighton University and received her J.D. from the Benjamin N. Cardozo School of Law. a Long Island sculptor, where the authenticity of a Willem de Kooning and de Kooning Studio sculptures was challenged among other issues. Elston reached a settlement agreement on the behalf of Pavia, who had many castings and enlargements of Kooning’s sculptures.
In 2011, Elston defended French art dealer Marc Latamie in an action brought by a New York art collector involving Andy Warhol "Electric Chairs" prints.
In 2013, Elston represented sculptor Lonny Morrow as he brought an action under the Visual Rights Act of 1990 seeking damages incurred as a result of the intentional acts, negligent acts and omissions of Javits Center which resulted in the destruction of one of his sculptures.
Also in 2013, Elston represented photographer Kevin Ryan against jazz singer Esperanza Spalding for failing to credit him or license his photographs. On the cover of 2012’s “Radio Music Society,” the singer is pictured sitting on a classic ’80s boombox. This boombox is actually a sculpture made of pictures attached to a wooden box. These photographs were taken by Kevin Ryan. The case was settled to the satisfaction of both parties.
Lectures and appearances
Elston has been an adjunct lecturer at the City University of New York College of Technology since 2012. She teaches “Law and Society” in the Social Science Department.
In the summer of 2015, Elston taught at the Summer Institute of Art. Her lecture called "Fair Use, Luc Tuymans, and Territoriality" is available on Vimeo.
On October 18, 2015, Elston lectured at NY LASER, a series of lectures and presentations on art and science projects, in support of Leonardo/ISAST’s LEAF initiative.
Other
Elston is a founding board member of WhiteBox, a not-for-profit arts organization located in the heart of the Chelsea art district in New York.
